Korte Suprema at Ombudsman, sinisira na ni Duterte – Lagman
Tinantangka umanong sirain ni Pangulong Rodrigo Duterte ang independence ng Supreme Court (SC) at Office of the Ombudsman.
Akusasyon ito ni Albay Rep. Edcel Lagman matapos hamunin ni Pangulong Duterte sina Ombudmsan Conchita Carpio-Morales at Chief Justice Maria Lourdes Sereno na sabayan itong magbitiw sa puwesto.
Iginiit ni Lagman na garantisado ng Saligang Batas ang independence ng SC pati na rin ang Office of the Ombudsman subalit “under siege” ito dahil na rin sa mga banat ng punong ehekutibo.
“The constitutionally guaranteed independence of the Supreme Court and the Office of the Ombudsman is under siege without legitimate anchorage,” sabi pa ni Lagman
Dagdag pa ng kongresista, ang impeachment complaint kontra Sereno ay pawang pinagsama-sama lamang na sabi-sabi na news accounts at hindi nakakapag-constitute bilang impeachable offense. “compendium of hearsay news accounts and the purported grounds do not constitute impeachable offenses.”
Lalo pa aniyang pinabigat ni House Justice Committee Chairman Reynaldo Umali ang sitwasyon nang sabihin nito na hindi maaaring pagbigyan ang legal counsel ni Sereno na ma-cross examine ang mga witnesses sa impeachment complaint.
“Compounding the gravity of the situation is the decision of Rep. Reynaldo Umali, Chairman of the Hose Committee on Justice, to deny the counsel of Sereno the right to cross-examine on behalf of the Chief Justice the adverse witnesses. Umali wants the Chief Justice to personally conduct the cross-examination despite her constitutional right to counsel of her choice,”
Maituturing din umanong unprecedented ang balak ni Pangulong Duterte na paimbestgahan ang Office of the Ombudsman, na tiyak makakasama rin daw sa independence nito.
“With the impending destruction of democratic institutions even as Duterte already has full control of the Congress, the military and police establishments, and the bureaucracy, an authoritarian rule can be a harsh eventuality,” Dagdag pa niya.
Dagdag pa ni Lagman, hindi na malayo ang authoritarian rule sa bansa kapag ganitong sinisira na raw ng pangulo ang demokratikong institusyon, kaakibat ang kontrol sa Kongreso, militar at pulisya.
